All party bookings, Nerf Time and tangible goods are sold subject to availability and to the terms and conditions, which can be found here. These terms and conditions should be read prior to purchase as purchasing a party, Nerf Time or goods constitutes acceptance of these terms and conditions. All party and Nerf Time bookings and tangible goods are subject to this Delivery and Refund Policy.
BOOKING CANCELLATIONS, EXCHANGES & REFUNDS
Party bookings are not eligible for a refunded after purchase unless the Party is cancelled, abandoned, rescheduled or where there is a material change to the Party. A material change is a change which, in MPA Parties Ltd’s reasonable opinion, would make the Party or Nerf Time materially different to the Party or Nerf Time that the purchasers of the booking could reasonably expect.
Refunds shall only be made to the person who purchased the Party or Nerf Time and, where possible, by the same method used to purchase the Party or Nerf Time. When it is not possible to refund via the same payment method MPA Parties Ltd reserves the right to request additional identification or documentation to ensure the money is returned to the correct person.
In the case of a cancelled Party or Nerf Time, Customers will be refunded the face value of the Party deposit or Nerf Time and any associated equipment hire.
In the case of a postponed/rescheduled Party or Nerf Time, Customers will be offered alternative bookings of the same value for the new date/time, subject to availability. Should the Customer not wish to accept this booking then a refund can be obtained for the face value of the booking and any associated hire fees.
If a Nerf Time is abandoned after commencing Customers will be offered, subject to availability, equivalent value bookings for an alternative Nerf Time or they will be refunded the face value of the booking and any associated hire fees they have paid.
MPA Parties Ltd reserves the right to cancel bookings which they reasonably suspect to have been booked fraudulently.
At MPA Parties Ltd’s discretion, a waiting list may be kept for sold out Party or Nerf Time sessions to assist Customers who can no longer attend. MPA Parties Ltd withholds the right to charge an administration fee for facilitating the transfer of bookings from one Customer to another. Should the place be filled the MPA Parties Ltd will refund the original customers payment.
DELIVERY TERMS – PARTIES & NERF TIME EVENTS
Parties and Nerf Time events purchased online are redeemable in person only and therefore not subject to delivery.
DELIVERY TERMS – TANGIBLE GOODS
If at any point tangible goods are sold by MPA Parties Ltd on this website then the following delivery terms will apply:
DELIVERY TERMS
Goods are delivered to the address specified by The Customer on the purchase order and only to geographic zones that MPA Parties Ltd service, (Currently the UK only).
In stock Goods will normally be dispatched on the same day, if ordered before 14:00 (2pm), after which they will be dispatched the next day.
Goods out of stock are normally dispatched within the approximated time scale of 3-10 working days after receipt of the order from The Customer, dependent on availability from suppliers.
Working days do not include Saturday, Sunday, and Bank Holidays.
Please allow 7 working days for cheques to clear before dispatch.
Incorrect personal details may lead to problems or delays in delivery. It is The Customers responsibility to ensure they have included the full address details, including accurate postcode of the delivery address and daytime contact telephone number and e-mail address to enable notification in the event that any delivery problems are encountered.
MPA Parties Ltd shall use reasonable endeavours to meet any date agreed for delivery. In any event time of delivery shall not be of the essence and MPA Parties Ltd shall not be liable for any losses, costs, damages or expenses incurred by The Customer or any third party arising directly or indirectly out of any failure to meet any estimated delivery date.
Delivery of the Goods shall be made to The Customer’s address and recipient of the order and The Customer shall make all the arrangements necessary to take delivery of the Goods whenever they are tendered for delivery. A delivery is interpreted by MPA Parties Ltd as ‘a delivery attempted by us or our selected couriers at the delivery address specified by The Customer.
As with any shipment, a delay or loss of Goods is possible. In such a case, the carrier shall start an investigation. Every effort is made, for as long as necessary, to find the package. If the package is not found, the carrier will reimburse MPA Parties Ltd, who will deliver a new, identical package to The Customer free of charge.
MPA Parties Ltd shall not be held responsible for delayed delivery times due to the carrier, including for the loss of Goods, bad weather or strikes.
Goods cannot be delivered without signature from the recipient.
Any Goods returned undelivered will incur and extra delivery charge for re-dispatch.
Title and risk of Goods shall pass to The Customer upon delivery of the Goods.
All Goods leave MPA Parties Ltd’s premises in perfect condition. The Customer must notify the carrier (or postman) of even the slightest trace of damage (holes, signs of crushing, etc.) to the parcel, and refuse the package if necessary. A new, identical product will then be sent to The Customer at no additional charge.
No exchanges can be made at a later time for Goods claiming to be damaged during carriage without notification at the time of reception.
LOSS OR DAMAGE IN TRANSIT
MPA Parties Ltd will not be responsible for damage or loss of Goods or part thereof in transit or for any discrepancy between the Goods delivered and the Goods ordered unless The Customer gives written or email notice of a claim to MPA Parties Ltd and the carrier within three (3) business days of delivery.
In the event of damage of Goods or part thereof in transit or for any discrepancy between the Goods delivered and the Goods ordered, The Customer must hold the Goods and make them available for inspection or collection by MPA Parties Ltd or its representatives on request.
DELIVERY ERRORS
The Customer must inform MPA Parties Ltd immediately (the same day or, at the latest, the first business day following delivery) concerning any claim of delivery error or non-conformity of Goods, in kind or in quality, compared with the information on the purchase order.
Any claim made after this time period will be rejected.
All claims must be made in writing and sent to MPA Parties Ltd, 7 Eldon Way, Hockley, Essex, SS5 4AD .
Any claim that does not respect the rules defined above cannot be taken into account and releases MPA Parties Ltd of any responsibility to The Customer.
In the case of delivery error or exchange, all Goods to be exchanged or refunded must be returned to MPA Parties Ltd in whole, in its original packaging and in perfect condition to MPA Parties Ltd’s address.
For claims to be accepted, The Customer must first make a declaration to MPA Parties Ltd concerning any returns and receive MPA Parties Ltd’s consent. If accepted, The Customer will ship the package to MPA Parties Ltd’s address.
Shipping fees shall be at The Customer’s expense, except in the case where the Goods do not correspond to the original declaration made by The Customer concerning the return.
Goods returned undelivered will incur and extra delivery charge for re-dispatch.
Title and risk of Goods shall pass to the Customer upon delivery of the Goods.
ORDER TRACKING
EVENTS
Orders taken online for Events will receive an automated email confirmation as long as The Customer provides this information at the time of booking. It is The Customer’s responsibility to attend the event as per booking.
Orders taken by phone or in person for Events will have an email conformation sent within an hour of receipt as long as The Customer provides this information at the time of booking. It is The Customer’s responsibility to attend the event as per booking.
TANGIBLE GOODS
Orders taken online for tangible goods will receive an automated email confirmation as long as The Customer provides this information at the time of placing the order.
Orders marked for collection in store are the responsibility of The Customer who ordered the item/s to collect. Identification and an order receipt should be brought in as proof of purchase.
Orders dispatched by MPA Parties Ltd to the customer are dispatched by Royal Mail or Courier and tracking details will be sent to The Customer by email once they are received by MPA Parties Ltd.
DELAYS
Orders received before 2pm Tuesday-Friday, if in stock, will be dispatched the same day. If circumstances arise that an item ordered is out of stock The Customer will be informed and provided with the option to cancel, or request dispatched as soon as said item is back in stock. The Customer will be kept informed of the progress of their order at all times.
RIGHT TO CANCEL
In accordance with UK Laws, The Customer has the right to cancel an order for tangible goods starting from the moment they place their order and ending fourteen (14) days from the day they receive their goods and return said goods at their own expense, without having to give a reason. All returns can be indicated beforehand with MPA Parties Ltd customer service department. All goods must be returned to MPA Parties Ltd’s address.
If an order consists of multiple goods, the 14 day period runs from when The Customer receives the last of the batch.
This 14 day period is the time The Customer has to decide whether to cancel, The Customer then has a further 14 days to actually send the goods back.
The cooling off period and right to cancel do not apply to contracts, orders for any Goods made to The Customer’s specification, any downloaded Goods or unsealed Goods including, but not limited to (DVD, CD, Tapes, Software, Video and audio) and orders for events.
Only complete and unused Goods in perfect condition for resale will be accepted. No refunds or exchanges will be made for incomplete, damaged or unsealed Goods, including damage to original packaging.
The Customer can exercise this right to cancel without penalty, excepting the return fee for the Goods. If The Buyer exercises the right to cancel, they have the option of requesting a full refund or exchange of Goods. If an exchange is requested, all shipping expenses shall be the responsibility of The Customer.
The Customer shall inspect the Goods immediately upon receipt and shall notify MPA Parties Ltd by phone or email; returns@mpa-parties.co.uk within three (3) working days of delivery if the Goods are damaged or do not comply with any of the contract. If The Customer fails to do so The Customer shall be deemed to have accepted the Goods.
Where a claim of defect or damage is made, the Goods shall be returned by The Customer to MPA Parties Ltd. The Buyer shall be entitled to full refund (including delivery costs) plus any return postage charges if the Goods are in fact defective.
If the right to cancel is exercised, Goods must be returned by The Customer and should be adequately insured during journey. MPA Parties Ltd will make every effort to refund The Customer within 30 days. However, if The Customer fails to return the Goods following cancellation, MPA Parties Ltd shall be entitled to deduct the cost of recovering the Goods from The Customer.
Goods to be returned must clearly show the order number obtained from MPA Parties Ltd on the order reference number on the invoice.
Where the returned Goods are found to be damaged due to The Customer’s fault, The Customer will be liable for the cost of remedying such damage.
DEFINITIONS
‘Booking’
means any payment made in purchase of a Party or Nerf Time, which confers the right to attend a Party or Nerf Time.
‘MPA Parties Ltd’
means any location where the Party or Nerf Time organised by MPA Parties Ltd is being held and representatives of this location including but not limited to the management, security and marshalling teams. In relation to tangible goods MPA Parties Ltd is the merchant selling said goods.
‘Participation Consent Form’
refers to the consenting mandatory form to be signed by all participants before participating in their initial Party or Nerf Time.
‘Party’
means any Party occurring at the MPA Parties Ltd in respect of which bookings are sold.
‘Tangible Goods’ / ‘Goods’
means goods which are physically able to be posted to a Customer.
‘The Customer’
includes both the person who purchased, or intends to purchase, a Party or Nerf Time booking or a gift voucher, and those within his or her party who are attending the Party or Nerf Time, each of whom must possess a valid booking.’
